Welcome to Sophie Kae Art Studio! These Terms of Use govern your access to and use of all digital courses, tutorials, websites, and content provided by us. By purchasing, enrolling in, or accessing our content, you agree to be bound by these terms.
1. Ownership & Intellectual Property
All materials provided in our programs—including but not limited to video tutorials, specialized crafting techniques, written guides, downloadable templates, formulas, and visual assets—are the exclusive intellectual property of Sophie Kae Art Studio.
Protection: This content is protected by Canadian and international copyright laws.
Restrictions: You may not copy, share, redistribute, resell, or repurpose any of our materials without express written consent from us.
2. Access Duration & Downloadable Content Policy
One-Year Access Limit: Upon purchasing or enrolling, you are granted digital access to the course portal, video lessons, and all digital assets for a period of one (1) year (365 days) starting from your exact date of purchase. After this one-year period, your access to the entire course portal will automatically expire.
Downloadable Materials (Manuals & Patterns): You are permitted to download the course manual, supplemental manual, and project pattern to your personal device strictly during your active one-year access window.
Post-Expiration Restriction: Once your one-year access period ends, your portal login is deactivated. You will no longer be able to download, view, or access these materials from our platform under any circumstances. It is entirely your responsibility to download and safely save these files to your personal device before your 365 days are up. We will not manually email files or grant access extensions for forgotten downloads after expiration.
Personal License: All downloaded manuals and patterns are granted under a single-user, non-transferable, non-exclusive license strictly for your personal educational use. Sharing these downloaded files with others or using them for commercial purposes is strictly prohibited.
3. Crafting Safety & Assumption of Risk
Our courses demonstrate artistic and crafting techniques using commercially available art supplies, including polymer clay. While polymer clay is certified non-toxic when handled and cured correctly according to manufacturer instructions, safe crafting practices are entirely your responsibility.
By participating in these lessons, you agree to:
Follow Safety Labels: Read, understand, and strictly adhere to all manufacturer instructions, safety warnings, curing times, and temperature guidelines on your clay’s packaging.
Monitor Temperatures: Use an accurate oven thermometer to monitor baking temperatures to prevent the burning, scorching, or off-gassing of materials.
Ensure Workspace Safety: Work in a well-ventilated area, and do not place raw, uncured clay directly on household surfaces, utensils, or appliances used for food preparation.
Assume All Risk: You acknowledge that you are voluntarily engaging in these physical crafting activities. You assume all risks of personal injury, property damage, or damage to household appliances (such as ovens) resulting from the use or misuse of crafting materials, tools, or appliances. The instructor and Sophie Kae Art Studio are not liable for any such damage or injury.
4. Payments, Fees & Refund Policy
Payment Processing: All payments are processed securely through our third-party merchants, Stripe and PayPal. We do not store, process, or have access to your credit card details on our servers.
No Refunds: Due to the immediate, digital delivery nature of our courses and downloadable content, all sales are final. We do not offer refunds, exchanges, or credits. Please review the course details carefully before completing your purchase.
5. Disclaimer of Warranties & Limitation of Liability
No Guarantee of Results: This site and its services are used at your own risk. While we strive to provide excellent, high-quality instruction, we do not guarantee specific artistic outcomes, skill levels, or results from using our programs. Your success depends entirely on your personal practice and execution.
Limitation of Liability: To the maximum extent permitted by the laws of the Province of Ontario, Canada, Sophie Kae Art Studio, its owners, and its affiliates shall not be liable for any direct, indirect, incidental, or consequential damages, injuries, losses, or property damage arising out of your access to our website or your participation in our courses.
6. Suspension and Termination
We reserve the right, in our sole discretion, to suspend or permanently terminate your access to our course platform without a refund if:
Any misuse or unauthorized sharing of your account login is detected.
You breach any of the intellectual property rules outlined in these Terms.
You engage in abusive, harassing, or unethical behavior toward the instructor or other community members.
7. Governing Law & Jurisdiction
These Terms of Use are governed by, interpreted, and enforced in accordance with the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein. Any legal action, dispute, or claim arising from these terms shall be resolved exclusively within the courts of Ontario.
